These Terms and Conditions apply to services provided by Finer Sound. By booking a service, the client agrees to the terms that have been made available to them before the booking is confirmed.
Any project-specific terms agreed in writing will apply to that project. Where there is a conflict, the specific written agreement will take precedence for that project. Nothing in these terms affects any rights that cannot legally be excluded.
Finer Sound provides audio services agreed with each client before work begins.
The services available may include:
Audio recording
Music mixing
Music mastering
Audio editing
Other audio production services agreed in writing
The exact work, deliverables, price and estimated completion date will be confirmed before the project begins.
Any work outside the agreed scope may incur an additional charge. Additional work will be discussed and agreed with the client before it is undertaken.
All prices will be agreed with the client before work begins and confirmed in writing.
Unless otherwise stated, prices are quoted in pounds sterling (GBP).
Where a deposit is required, the amount and payment deadline will be agreed before the project begins. Work may be scheduled to start once the agreed deposit and required project materials have been received.
The remaining balance must be paid by the due date stated on the invoice or project agreement.
Finer Sound may withhold final deliverables until the agreed balance has been paid, where this has been made clear to the client in advance and is permitted by law.
If a payment is overdue, Finer Sound will contact the client to request payment. Any interest, late-payment charges or recovery costs will only be applied where legally permitted and applicable to the agreement.
Invoices will state the applicable payment details and payment reference.
Unless otherwise agreed in writing, each agreed mixing or mastering service includes two rounds of revisions.
A revision round means one consolidated set of feedback from the client, followed by the corresponding changes from Finer Sound.
Clients should provide clear feedback in one message or document for each round wherever possible.
Revisions are intended to refine the agreed work. They do not automatically include:
A substantial change to the original brief
New recording sessions or replacement recordings
New tracks or materials supplied after the agreed work has been completed
A complete change of creative direction after approval
Additional services not included in the original agreement
Additional revisions or work outside the agreed scope may incur an extra charge. The additional work and price must be agreed with the client before proceeding.
Clients are responsible for providing the audio files, recordings, references, instructions and other materials required for their project.
Clients should ensure that supplied files are accessible, complete and in a suitable format.
Clients must have the necessary rights, permissions and licences for any recordings, compositions, samples or other materials they supply, and must obtain any permissions required for the intended use of the finished work.
Delays in receiving materials, feedback, approvals or payments may affect the estimated completion date.
Finer Sound will communicate any significant changes to the expected delivery date.
Deliverables will be supplied in the formats agreed with the client before work begins.
Estimated completion dates are provided in good faith and may change if the project scope changes or materials, feedback or payments are delayed.
Finer Sound will take reasonable care when preparing and delivering audio files but cannot guarantee that files will be compatible with every playback system, platform or technical setup.
Clients should check their delivered files and notify Finer Sound of any apparent technical problems within a reasonable time.
Clients are responsible for keeping their own copies of delivered files. Finer Sound does not guarantee indefinite storage or future availability of project files, sessions or backups unless this has been agreed in writing.
If a client wishes to cancel a project, they should contact Finer Sound as soon as possible in writing.
If a project is cancelled after work has started, the client may be responsible for the reasonable cost of work already completed and any agreed, unavoidable costs incurred for the project, subject to applicable law and the terms of the agreement.
Any advance payment or deposit will be accounted for fairly, taking into consideration the work completed, applicable cancellation rights and any refund required by law.
If Finer Sound needs to cancel a project, the client will be informed as soon as reasonably possible. Any refund or other remedy will be handled in accordance with the agreement and applicable law.
Changes to the project scope, deadline or deliverables must be agreed in writing. Such changes may affect the price and completion date.
Nothing in this section removes any statutory cancellation, refund or consumer rights that apply to the client.
Clients retain ownership of their original compositions, recordings and other materials they own or are authorised to use.
Clients are responsible for ensuring they have permission to use any third-party materials included in their projects.
The ownership and permitted use of newly created recordings, edited audio and other deliverables will be determined by the applicable project agreement and any relevant law.
Unless otherwise agreed in writing, Finer Sound does not claim ownership of a client's pre-existing music or recordings merely by providing audio services.
Once all agreed payments have been made, the client may use the final deliverables for the purposes agreed for the project, subject to applicable third-party rights and any specific written agreement.
Finer Sound will not publish a client's unreleased music, share project files publicly or use a client's work in promotional material without the client's permission, unless otherwise agreed in writing.
Finer Sound will carry out agreed services with reasonable care and skill.
Audio production involves creative judgement, and clients may have different preferences regarding sound, balance and overall presentation. Finer Sound cannot guarantee commercial success, streaming figures, audience response, record deals or any particular artistic outcome.
Clients are encouraged to provide references and clear instructions before work begins.
Nothing in these terms excludes or limits any legal responsibility that cannot lawfully be excluded or limited.
Finer Sound will take reasonable care when handling client materials and completing agreed work.
To the extent permitted by law, Finer Sound is not responsible for losses arising from circumstances outside its reasonable control, including third-party platform failures, client-supplied file problems or delays caused by missing materials or feedback.
Any limitation of liability will apply only to the extent permitted by applicable law. Nothing in these terms excludes liability for fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
Clients should retain backups of their original recordings and project materials.
Finer Sound handles personal information in accordance with its Privacy Policy, available on the Finer Sound website.
Personal information will be used only for appropriate business purposes, such as communicating with clients, managing projects, issuing invoices and maintaining required business records, in accordance with applicable data protection law.
Finer Sound may update these Terms and Conditions from time to time.
The applicable terms for an existing project will be those agreed with the client for that project. Material changes will not automatically be applied retrospectively to an existing agreement without an appropriate basis.
These Terms and Conditions are governed by the laws of England and Wales, subject to any mandatory legal protections that apply to the client.
Any disputes will be handled in accordance with applicable law.
